Followup added to fix the first issue Nick found.. can't believe that got
through so many QA eyes.. it was even incorrectly tested for in the tests,
highlighting the issue.

I'm not sure I fully understand your second comment though Nick... is that
something that can go in a second bug with a clear description of what you
think should happen?
