In 'modern' versions of Koha it should not create an issue with the fine
calculations if the item is returned, but I could understand if libraries want
to insist on having the items back first. 

The check would have to be clever enough to check if the fine is still accruing
or not since the item could have been renwewed or checked in/checked out again.
