I think that's the idea. Here's a question, what does the 'lists' permission do? As far as I can tell, it does nothing!

You are correct, this has not been correctly implemented from the start. We have a top level permission, 'lists' where people expect it allows/disallows access to the lists area in staff, but that does nothing. It was only created for the sub-level permission about being able to delete public lists. See bug 13888.
