Because something would say so -- perhaps a little web service we add to the website.
 
A lot of software has “About –> check for updates”
If it wasn’t triggered unless they expressly went to the “check for updates” tab, I don’t see why you need to worry about opt-in or opt-out.

Opt-in would be required for any automatic, periodic check -- some jurisdictions have strict laws forbidding software where from phoning home unbeknownst to the user.  Just having a "check for updates" button perhaps wouldn't need a separate opt-in step, but would have to make it clear that it was getting information from a remote server.
