Can you provide a replication scenario for this bug?
C4::Letters::_send_message_by_email does not require that to_address
be supplied when the notice is added to the message queue, since it
can and does look it up.  Since that is also where the check of the
AutoEmailPrimaryAddress syspref resides, specifying the patron email
address explicitly would break the functionality of that syspref for
overdue notices.
