Am I not taking the same steps as you were? Can you reproduce the issue repeatedly?
One question. Were you running from user account or system account? Where you running from an upgrade or a fresh install? My scenario, I drop'd the db, created an empty one, did the web install and was using the system account. root -> group 1 -> subgroup 1 & subgroup 2 add libraries to subgroup 1 & subgroup 2 attempt to delete root.
