This should be since version 3.07.00.037, although my production database somehow did not have 40 for field 008.. We can easily add the same check for 005, 006 and 007. Over in bug 23391, we introduced a syspref in which one can define statuses for which to hide ILL requests. I've also hit this when looking into bug 30287. So.. recording this here and hopefully we'll find some time to work on it. Personally..
